On one hand, the Obama administration is petitioning the SCOTUS to force states to comply with international convention (to which the US is not currently a party) by advising suspects of their right to contact the consulate of their home country (which presumes that police must first inquire as to the immigration status of a suspect.)
On the other, the Obama administration is separately suing to prevent states from allowing police to attempt to ascertain the immigration status of individuals who have been stopped pursuant to routine law enforcement activity.
