I read the County’s rebuttle, and it seems fairly strong, but also dances around the threat of arrest during training and disqualifies some key points with technicalities.

This lawsuit lays out many of the grievances I have with the licensing process in Suffolk County, especially the long delays. It's absolutely ridiculous. Very happy to donate to the cause and would encourage others to do also regardless of the amount.

Its about goddamn time, the first 6-18 months has NOTHING to do with applying for the STATE license, all Suffolk related questions, steps, etc. that the state does not even recognize, but Suffolk treats it more like a county license, it needs to come to a stop, one state, one process, just like any other license.

The NYSRPA is looking for individuals, who meet the requirements listed below, to join our challenge. Please respond to this email with your name and contact information if you are interested in becoming a plaintiff in the lawsuit and meet any of these requirements:

  1. Submitted after September 1, 2022 an application for a carry license and that application was denied.
  2. Submitted after September 1, 2022, an application for a carry license and that application is still pending.
  3. Possess an unrestricted carry license and desire to carry a firearm into any of these locations:
1. A place controlled by the federal, state, or local government that is used for government administration.
2. Public transit (bus, ferry, train, subway, etc.);
3. Library, public playground, public park, zoo, nursery or childcare center, or summer camp.
4. A mental health or addiction facility or place for individuals with developmental disabilities.
5. A homeless or domestic violence shelter.
6. A senior center.
7. Theater, sports stadium or arena, racetrack, museum, banquet hall, or casino.

All responders should not otherwise be prohibited from obtaining a carry permit.

dont they have people already? Dose this indicate they might not have standing in that case? I would sign up but i dont fit the criteria as i already got my carry

I would suspect they're looking for more plaintiffs, to make it harder for NYS to pull standing tricks and you would qualify, under requirement #3.

Presumably for admitting to shooting a handgun in NY without a license in order to qualify.
Which is not illegal, btw.

Funny enough, I heard an instructor tell me today that NYSP, Nassau and Western Suffolk were telling people that they CANNOT allow students to take the course first. And even that the instructor could be arrested!

Personally I hope the rumor is true just so the guy who was arrested and his attorney could retire very wealthy.

well thats not necessarily tru you can shoot a real gun with simuntion to pass your 18 hour people at my class used it that had no permit yet but that was back in September so thing might have changed
Shooting a real gun with simmunition is legally the same as shooting a real gun with real ammunition.

What makes it legal is not the type of gun, but a change in Penal Law Section 265.20, adding paragraph 3-a and saying you no longer need a license to shoot with an instructor.

I find it absolutely incomprehensible that law enforcement and their legal bureaus apparently have not read the CCIA. The CCIA specifically amended the NY Penal Law to exempt unlicensed individuals undergoing live-fire training under the supervision of a duly licensed instructor. The attached PDF has three sections: (1) the top section is the actual language in the CCIA; (2) The middle section is the opening paragraph to Section 265.20 which lists the exemptions to criminal possession of a weapon; (3) the bottom portion is paragraph 3-a which was added to Section 3 of PL 265.20. I have also attached the full CCIA.

PeconicPaladin is absolutely correct, the law allows live-fire training for an unlicensed individual as long as the person is supervised by a duly authorized instructor such as NRA Instructors or Officers of the Armed Forces (active and retired).
