"In a 3-0 vote, the 2nd U.S. Circuit Court of Appeals in Manhattan said the NRA's bid for an injunction was moot because there was "no reasonable prospect" of more closures, after the state legislature curtailed the governor's power to impose COVID-19 restrictions."

That ruling makes about as much sense as a judge ruling that a murderer doesn't need to be prosecuted, because the legislature passed another law, saying that committing more than one murder is not allowed and, therefore, the perp can't do it, again. The un-repairable damage, to those businesses, was done, solely for personal and political purposes and is prosecutable. But, then, this is NY.
