A Manhattan judge crushed a ban on Styrofoam and related products supported by Mayors Michael Bloomberg and Bill de Blasio - saying there's plenty of evidence that recycling the materials could save the city at least $400,000 annually.

Mayor Bill de Blasio's office announced the ban on Styrofoam on Jan. 8.

Justice Margaret Chan overturned the ban that went into effect on July 1, though penalties were delayed until 2016.

A coalition of business owners sued the city this year, saying the ban was only instituted for political reasons.

Chan ordered the Department of Sanitation to make a plan for how best to recycle polystyrene foam products.

She noted that Commissioner of Sanitation Kathryn Garcia calculated that the city would save $400,000 a year if 40 percent less Styrofoam went into landfills.

Yet Garcia said that recycling the material "would not be environmentally efficient [or] economically feasible."

Chan said the business owners proved the opposite is true.

"The commissioner's concern is not justified given the abundant evidence showing a viable and growing market for not just clean expanded polystyrene foam but post consumer material," she said.
The products currently constitute only 0.8 percent of curbside waste and 28,500 tons in landfills.

I think you should be allowed, in any store, vehicle or building, up to 7 styrofoam cups at a time.
No more, however. Large capacity styrofoam cups will be banned, as will styrofoam cups with conspicuous grips and drip hiders.
Also, no fully automatic styrofoam cups, only those that require a seperate and manual fill each time they are emptied.
I am going to call my legislation the UnStyro Act.

The new styrofoam license will have a $10.00 recycling fee tacked on since the Department of Plastic Licensing will assume that you will improperly dispose of your styrofoam and will punish you upfront for the thought of it. If you want to leave your house with your styrofoam you will have to have a CCC endorsement (coffee cup carry).

The sixteen ounce high capacity styrofoam cups are still banned in NY. You can possess a 10 ounce styrofoam cup, however you can only fill it with 7 ounces of liquid. Why would anyone need more than 7 ounces?

And what about the household iron you buy in CVS., open the box and pull out two giant chunks of styrofoam?

Another stupid, unenforceable law dreamt up by legislators to convince us they are "doing something" besides playing golf on our dime.

You know what would be great? If they spend the same time and energy looking at bogus old laws, of which there are a million on the books, and tossing stuff out. We need LESS laws and BS, and more common sense.
