NEW YORK'S SULLIVAN ACT CHALLENGED IN FEDERAL COURT

Buffalo, NY. August 9, 2015. A group of citizens have filed a frontal legal assault on New York's pistol permit law, known as the Sullivan Act, after the corrupt Tammany Hall politician who sponsored it in 1911. The statute requires law-abiding citizens to get government permission before arming themselves against the hordes of violent criminals roaming New York's streets.

The lawsuit, filed in Federal Court in Buffalo, complains that alone among the fundamental rights spelled out in the Bill of Rights, only the right to bear arms requires that citizens get government permission before exercising it.

The complaint notes that seeking such permission can takes years and several thousand dollars and is often denied arbitrarily.

The plaintiffs in the case are the Libertarian Party of Erie County, four residents of Erie County, Michael Kuzma, Philip Mayor, Michael Rebmann and Edward L. Garrett; Richard Cooper of Nassau County, Ginny Rober of Broome County and David Mongielo of Niagara County.

The defendants are Governor Andrew Cuomo, Attorney General Eric Schneiderman and State Police Superintendent Joseph A. D'Amico.​

The plaintiffs are from Buffalo, Binghamton and Nassau. That seems intentionally spread out to cover the whole state.

Because it's being heard upstate, the ruling won't effect the plaintiff (or any of us) from LI?

Either way I'm glad to see it. I hope they set up a way to donate to the effort.

New York's political machine is like "original evil". It's been around since before there was a United States. It eats it own. Anything coming out against the Sullivan Act from the Feds that ain't from SCOTUS will get engulfed, contained, and ignored.

Even if something comes from SCOTUS the "machine" will work to contain it. It won't relent without a specific threat from SCOTUS.

And I don't think SCOTUS has the stones.
