Father of Four Shoots Intruder Armed With Hammer

KINGSBURG, Calif. (KMPH) -
A Kingsburg man opens fire, and now the father of four is being called a hero.

Deputies say he shot a man who broke into his home.

The intruder acted stupidly! Here's an excerpt from the article.....

He used the hammer to break the living room window, where Duran was waiting.

"When I see him come to me, I shoot at him," said Duran.

He fired one round from his .357 magnum revolver in an effort to protect his four children and his wife, who were all home.

"I don't like somebody to put one finger on anyone in my family," said Duran.

The intruder was hit in the thigh.

"I never think about killing him. I want to stop him," said Duran.

And he did.

The intruder fell back, and the father of four stood over him, holding a gun to his head while waiting for deputies to arrive.

"He told me 'I want to kill people.' I told him, you move one finger, I'm going to shoot you on your head," said Duran.

shoot to kill if you have to but glad to hear the family is ok
An intruder is an Intruder armed or not I'd Justify the 2nd Shot.
The guy beat his dogs with a hammer and verbally confirmed that he was there to kill his family, so he shot him in the leg?

He must really trust our criminal justice system to reform people.

He said that he wasn't thinking about killing, he just wanted to stop the intruder, which is the correct thing to do.

Killing someone because you don't believe that the justice system will punish them sufficiently or will allow them to re offend is not self defense, it is execution.

I would have shot to kill, but only because it's the only reliable way to stop someone; ie. if deadly force is warranted in the first place, then deadly force is what you should use. The mistake he made was believing that a non-lethal shot would stop the intruder. In this case, he was lucky because it did stop him.

Perhaps he made the right decision to not shoot to kill but this guy will probably be back on the street in a few months or years and he will have to keep looking over his shoulder hoping this guy is not trying to get back at him.  There is a reason that you are taught/trained to shoot to kill.

If he is showing a hammer what else could he have been carrying under his shirt? Took a risk only wounding him!
I misunderstood the title of this thread. I thought the father used a hammer to shoot the intruder.
Great to read this, 2 words next time..."center mass".
The article said that no charges were being filed....so I imagine the cops came, they investigated then they left.

If this happened here in NY....would the homeowner automatically be arrested? Is there any way that someone here in NY can defend his/her family without leaving in hand-cuffs?

And when the guy gets out on reduced charges and probation in a couple months, now armed with the knowledge of your family's address, home layout, and home defense preparation?

I'm not saying he should have executed the guy after wounding him, I'm saying he made a mistake by wounding him.
