Killing someone because you don't believe that the justice system will punish them sufficiently or will allow them to re offend is not self defense, it is execution.
I would have shot to kill, but only because it's the only reliable way to stop someone; ie. if deadly force is warranted in the first place, then deadly force is what you should use. The mistake he made was believing that a non-lethal shot would stop the intruder. In this case, he was lucky because it did stop him.
