BREAKING NEWS: @NRA scores a HUGE win in California today. The 9th Circuit, led by a Trump-appointed judge, rules that ban on magazines with more than 10 rounds is UNCONSTITUTIONAL.

This case will have repercussions nationwide.

SACRAMENTO, Calif. (AP) – A three-judge panel of the 9th U.S. Circuit Court of Appeals has thrown out California’s ban on high-capacity ammunition magazines.

The panel’s majority ruled Friday that the law banning magazines holding more than 10 bullets violates the constitutional right to bear firearms.

California Rifle & Pistol Association attorney Chuck Michel calls it a huge victory.

The ruling has national implications because other states have similar restrictions.

California Attorney General Xavier Becerra did not immediately say if he would ask for a full court review or appeal to the U.S. Supreme Court.

He also did not say if the state would seek a delay to prevent a buying spree.

As many as he legally allowed. 

Regardless; if CA will take it to the SCOTUS that turncoat Roberts will reverse it.

Unfortunately the 9th doesn’t help us here in New York. California May appeal it to the SCOTUS. We need Trump to win in November. Biden announced he’s going to ban semi automatic rifles or known as the AWB.

If this withstands an en banc hearing, it creates a Circuit split that must be resolved in the SCOTUS.

At oral argument, the panel was most interested in pistols that most  commonly held 15 rounds before the ban, making 15 not unusual.

 

By that criterion, 30-rd rifle mags  might also be protected.

 

I don't think above 30 will enjoy Constitutional protection.

The California law violated the Second Amendment. Having a 33 round 9mm Glock magazine is in common use throughout this country. It will certainly be appealed, or will go to the SCOTUS because of circuit splits. I would take years, hopefully Trump is elected in November. I can’t see RBG or Breyer lasting another 4 years.

They will try to have it overturned in an en banc hearing. That is what they always do. However, I think Trump has not appointed the majority of 9th Circuit stooges. Wait and see.

This is good news. The NY legislature will never change the law that limits mags to 7. But I can't imagine any DA would ever prosecute anyone for have a 10 round mag with this ruling out there. Or would they?

There is no 7 round limit in NY anymore.  The NY Appellate Court threw it out.  They upheld the 10 round limit.

The 9th Circuit decision is of no value to NY'ers.   It will likely be thrown out by the full en banc panel as has other 9th Circuit pro 2nd Amendment decisions.

As a retired (3 years now) Floridian with too much time on my hands I've taken to investing in larger magazines for my firearms.  Freedom in the time of COVID-19 doesn't afford us much freedom in Florida now.
