Many radio hosts including those right leaning are saying "moot point as N.Y.C. has already tabled the proposal" they just don't get the big picture

Lol...just read the transcript. As I thought, the NYC lawyer for the idiot police totally EFFed up his case. Alito asks if you are violating the new regs if you stop along the way. Dearing basically says “I have no idea” cause the State law doesn’t define stops. So he says that will have to be litigated AGAIN.

Looks like Roberts was siding with the Liberals to moot the case. Oh well, I am sure the two conservative justices wanted to further expand the Second Amendment with traveling outside the home.

She told Clement that he was asking the justices to take a case “in which the other side has thrown in the towel” and “opine on a law that’s not on the books anymore.”

has me confused. While NYS passed a law removing the ban how could this case be moot if the 2nd Circuit Court said the ban was Constitutional? If the 2nd Circuit ruling is allowed to stand unchallenged NYS could enact the same ban at some future date. What is being challenged is the constitutionality of this and similar bans.

I heard Roberts voted in favor of Heller, voted for the 2nd amendment in that case.

That was then. I suspect he is a Never Trumper.

Some simple discussion that anyone can understand is when one of the Justices asked the NYC representative is the city or state less safe now that the law to prohibit gun owners from take a fire outside the city has now been repealed by the state. His answer was no, the city is not less safe. Well that opens up the question, if repealing the law does not make the city less safe why was the law prohibiting pistol license owners from taking their firearm to a second home or to a range outside the city passed in the first place? Duh!!!

My friend, you don't have faith in the ability of the SCOTUS judges, to see the obvious legal and practical implications of that which was admitted, by the NYC defenders. The judges will not allow this to be mooted. It is going to trial. The only item in question is how broad will be their decision, come May/June, next year, for this suit. The sentiment and legal scholarship is swinging, in favor of the application of strict scrutiny. The key will be how far Roberts wants to take this decision. He may throw the whole basket of eggs into one decision or cause it to be a narrow one, to be followed, then expanded, by the in-the-wings cases, all of which are hitting on different points of law. The city and state have made too many errors and reached too far, in their application of subjective factors. They have violated Heller and McDonald, regularly, to the consternation of SCOTUS.

The MSM is doing a great job at reporting that the case is moot. RBG led the charge. As of now, it’s a victory for the residents of NYC who may legally travel outside of NYC with their handguns.
The SCOTUS didn’t moot the case yet. We have to wait until the end of June for a ruling. Many legal experts are saying this case will eventually address the issues brought up during the oral argument.
