That's exactly what it says. The way it reads, if the sale takes place in Nassau or Suffolk County, it is legal. If the BUYER is a resident of NYC, they may have some legal hoops to jump through if they intend to posses that rifle in NYC. That shouldn't have any effect the seller, since the sale is legal in both the State and County.

Let's say a NYC resident is also a hunter and owns a second property upstate. Their driver's license will show NYC as their address. What if they buy a rifle privately outside the city and keep it at their upstate residence - never taking it into NYC. How could NYC take any legal action against that? The person has not done anything wrong nor have they violated any NYC or NYS law, right?

Just thinking out loud here. I know what is written is NOT always how things are enforced, especially when the re-interpertation works in the government's favor and against the citizen.


added: I would also question the title of this topic. "Crackdown" implies a stricter enforcement of the law. If true, this sounds more like NYC creating its own rules and attempting to enforce them across borders in jurisdictions where neither the written or newly invented rules do not apply.

Precisely. Archduke Mike wants guns out of New York City. Correction....he wants the guns out of the hands of law abiding citizens in NYC. I for one really need to hear more before jumping to any conclusions.

Bottom line, if it's a long gun, and, legal to own in Nassau or Suffolk County, it's legal to sell in Nassau or Suffolk County, to any adult. The burden to register in NYC is up to the buyer.

I check id's or ask for a pistol permit

I also have a bill of sale which states which rifle / pistol is being sold - make, model, caliber, serial number, condition, and waiver of liability including sale as is, I record seller and buyer id types and numbers on the paper and we both sign and get copies.

I also dont sell a firearm with the means to use it immediately - meaning i will ship the ammo if I have included it in the sale or drop it off to them later

Wow, what an opinion. And, I agree whole-heartedly. What the population doesn't realize is that when the mayor talks about "common sense regulations", he's really talking about total disarmament.

well said - I can only hope that Nassau and Suffolk act like VA and issue warrants for this thugs arrest, that would be the day - maybe that can be something Mangano should look into, hed get my vote for life........

4) if you live in NYC, you may purchase a long gun, outside of NYC, if you also store it, outside NYC.

I'm a NYC resident and have bought several rifles in Nassau and in Pennsylvania.  It's 100% legal and within my rights as long as I do not store them IN NYC.  My family has property in PA and I keep all of my firearms there.

I've been looking for it, too, but can't find anything. If the source is reliable, then it's possible they're not releasing any information until they've made some more arrests.

   Let me suggest we look at this, in a slightly different way: If the NYC boobs are dumb enough to arrest anyone, for a legal action, the arrested person has perfect grounds for a major lawsuit. +1, for us.

I suspect, if they are arresting sellers, the buyer is making some comment about not being able to pass a back ground check during the transaction. I am not an expert on the law, but I believe, if the seller knowingly sells to someone who cannot pass a back ground check, he did in fact commit a crime. This is the stunt they pulled at the out of state gun show sting.

This would be my take on it.

In addition, I always get a bill of sale in a private purchase. You have no way of knowing (and neither does the seller if he isn't the original owner) the history of the firearm. If the firearm being purchased has been used in a crime at some point in the past I at least want something to show that I didn't own the firearm when the crime occurred.

Let's just say that the undercovered NYPD police told the seller that thay could not pass the background check, and the seller didn't mind and sold them the long gun, could that authorize NYPD to make an arrest in Nassau?  My common sense says no.  I would say that the nassau police have to step in and make the arrest.  Am I right or wrong?  If I am right, then what happened on the raid at T&T gunner?

If it is a felony the NYPD officer can make the arrest, if less than a felony they generally will not stop, detain or search without County or State PD.  If they are here on official busines sand Nassau knows and has consented...I wouldn't hold them to any rules...
